FATF Pressures Independent UBO Verification

Global FATF evaluations signal that Hong Kong TCSPs must move beyond self-declared data for UBO verification.

As regional financial centers undergo continuous rounds of mutual evaluations, the Financial Action Task Force (FATF) has sent a clear message that impacts Hong Kong’s corporate service sector. A key takeaway from ongoing FATF assessments globally is the critical gap in Ultimate Beneficial Ownership (UBO) verification.

For Trust and Company Service Providers (TCSPs) in Hong Kong, simply collecting self-declared UBO information from clients is increasingly scrutinized. The FATF has highlighted that self-declared data often remains unverified, creating severe blind spots, particularly when dealing with foreign companies, variable capital companies, or complex trust structures. Regulators globally are demanding independent corroboration of this data.

TCSPs are expected to integrate advanced corporate ownership data tools to independently trace ownership across related entities and through complex cross-border structures until the ultimate natural person is identified. Compliance teams are audited on whether their UBO data is not only verified at onboarding but actively maintained as client circumstances change over time.

The expectation is shifting from basic data collection to robust, continuous verification supported by a clear, independent audit trail. Adapting to these stringent FATF expectations is vital to minimizing regulatory friction with the Companies Registry.
